Real ID and E-Verify are Unconstitutional

The “Legal Workforce Act” (H.R. 2164) would require businesses to use the new, still-being-developed federal E-Verify system to ensure that new hires are either American citizens or legal immigrants. Supporters of this intrusive legislation dubiously assert that it could “open up millions of jobs for unemployed Americans and legal immigrants.” The bill, however, is hardly an innocent attempt to ensure that workers are in the country legally. The Modern Day Police State and the Dangers of Real ID & E-Verify

Waldron4sheriff.com - A few months ago I came across several news articles regarding a Manatee County Sheriff’s Office Deputy who identified and arrested a woman who had been a Federal Fugitive for 23 years. What caught my attention is that this arrest occurred at the Manatee County Tax Collector’s Office located at 819 301 Blvd. West Bradenton, Florida. The article went on to describe how the Tax Collector’s Office hired the Deputy Full-time in February 2011 due to concerns about possible threats towards employees and safety issues arising out of the implementation of the Federal Real ID.

The Manatee County Tax Collector pays the Deputy’s salary to Sheriff Brad Steube to have the uniformed Deputy and marked patrol car stationed at the Tax Collector’s Office full-time. Since having the Deputy stationed at the Tax Collector’s Office, Deputy Jacobus has made 102 arrests and issued 28 traffic citations in less than a year.

The average uninformed citizen might think this is a great idea, along with having a sense of safety and security when visiting this office to re-new your driver’s license, obtain your driver’s license for the first time, obtain a Florida ID card or to register your vehicle in Manatee County. Physically you may feel safer, but this comes at the high cost of surrendering all of your Constitutional Rights and Liberties along with your privacy as soon as you walk through the doors.

When you walk into the driver’s license branch at the Manatee County Tax Collector’s Office, you aren’t given a form to sign which authorizes the Tax Collector’s employees or the Deputy stationed there to violate all of your Constitutional Rights and Privacies. You don’t have to because you have just entered a Police State where you have no rights. This isn’t legal, or constitutional, but it is happening on a daily basis.

I was very concerned about these practices so I checked into this myself and what I learned is very alarming concerning the activities within the Manatee County Tax Collector’s Office and the Manatee County Sheriff’s Office.

The Clerks at the Manatee County Tax Collector’s Office send text messages to the Deputy, which contain your name, date of birth and/or your driver’s license number so that the Deputy can conduct a criminal wants and warrants check on you or confirm your driver’s license status. This is a major violation of numerous laws because now your personal information has been communicated via an unsecure personal electronic device.

In lieu of that method the Deputy is given all of the old driver’s licenses which people surrender when they are renewing their driver’s license/ID Card. The Deputy then runs a criminal wants and warrants check on everyone from his laptop computer which is in the public view of all the employees at the Tax Collector’s Office. If you have a warrant you are then arrested. These practices and procedures are unethical, unconstitutional and extremely illegal. A law Enforcement Officer may not use a computer to access criminal databases which the public or non-certified employees who are not FCIC/NCIC certified can see or view. Also those same computers must be used in a secure location and not left unattended when the Deputy takes a break or goes outside to conduct VIN verifications, etc., which is exactly what is occurring at the Manatee County Tax Collector’s Office Driver’s License Branch.

With the Implementation of Real ID, you have to prove that you are an American Citizen all over again. It doesn’t matter that you were born in the United States or how long you have legally lived in the United States. You must bring with you all of your papers, birth certificates and supporting documents and prove all over again that you are who you say you are. This is reminiscent of 1935 Fascist Germany the only thing missing is a Jack-booted Storm Trooper or Gestapo Agent stating, “Your Papers Please”. In this day and age there is no need to mark subversives or undesirable people with white arm bands containing the yellow Star of David because all of your information is contained within your driver’s license, law enforcement databases, with civilian clerks using biased based profiling to single you out.

When you go to vote now in Florida, you don’t need your Voter ID card. It has become obsolete. Your driver’s license is scanned and all of your information comes up in the Supervisor of Elections computer system with your name, address, your party affiliation and the county you are registered to vote in.

The magnetic strip on the back of your driver’s license can even be accessed from several feet away by Law Enforcement and TSA who have the proper scanners to read this information. Along with your personal information, the magnetic strip on your driver’s license contains the addresses of every location you have ever lived at since you had a Florida Driver’s License, all the vehicles you currently or previously have owned for the past 20 years or so, the names of your Insurance carrier, and links for the photocopies of all the supporting documents which you submitted when you had to prove you are an American Citizen and more. Your Driver’s License is tied into the Driver and Vehicle Identification Database (D.A.V.I.D.), which contains all of this information plus records of every ticket you have received in Florida, the dates, locations and issuing Agency for those citations. I have seen this information used by law enforcement to determine if they are going to write you traffic citations when stopped for a new violation. The more citations you have previously received the higher the likelihood you are going to receive a new citation.

E-Verify is just as dangerous and used in the same manner. With E-Verify someone having access to the database including employers can now know every place of employment you worked at, where you live, your social security number, if you are a naturalized citizen or an immigrant. E-Verify been passed in several states and has been authorized under the guise of public safety and to keep illegal immigrants from “Stealing” your jobs. Florida has yet to pass such legislation and hopefully will never do so. There are problems and issues with E-Verify and it is not infallible. If there happens to be a glitch in the system or your information is not entered properly then you will be prevented from obtaining a new job and will have to prove all over again that you are a Citizen of the United States. George Orwell was right, Big Brother is here and thriving in America.

Just because a Judge, State Legislator, Federal Legislator or one of the numerous Federal Regulatory Agencies makes a ruling, passes a law or bill or creates a new regulation it does not mean it is legal or Constitutional. Many of these laws, regulations, legal opinions and bills are in fact illegal and unconstitutional. Bills and regulations such as Real ID and E-Verify are unconstitutional and only further subvert and erode the Constitution of the United States. Only the United States Congress can propose an amendment or a vote of two-thirds of all state legislators can amend the Constitution. The Constitution cannot be changed, but only amended. Even then, it cannot be done so to subvert or destroy the Constitution.

This is why I am running for Sheriff in Manatee County, Florida. I will be a Constitutional Sheriff and the first ever in Manatee County if I am elected. Your County Sheriff can push back against these abuses and nullify unconstitutional laws by refusing to enforce them, further protecting his/her citizens.
